| As the notice period is meant to be served, the employer cannot force his employee to go on leave during the period of notice, unless the employee consents to it. Any unconsumed annual leave can be encashed by the employee. |
If employer choose not to pay the employee the unconsumed annual leave, employer should allow the employee to choose to offset the leave or to clear the leave. What I get, is not allow to choose, straightaway offset. If I had not insist to clear my leave, clearing my leave is not going to work out. Further back to what written above, I hate the word “Any unconsumed annual leave can be encashed by the employee.” It should change to “Any unconsumed annual leave must be paid to the employee in cash. When he/she choose not to offset.”
